Wellness Dreams Terms and Conditions
If you are late to any Appointment, you will have the remaining time allotted for the Session. If you are absent to any Session without notice for any reason whatsoever, you will forfeit that Appointment and - for Single Sessions - the payment thereof. You would then have to reschedule that Session, subject to availability and the following terms. Home visits must be within a 15-mile radius from the business location.
For Single Session Appointments: You are only able to schedule a time between 3 hours and 30 days prior to your desired Appointment. To avoid any charges, rescheduling and cancellation must occur at least 24 hours prior to the scheduled Appointment and made within the next 30 days, otherwise you will forfeit that Appointment and the payment thereof.
For Monthly Plans: You must schedule all Appointments and attend all Sessions before each renewal date, otherwise you will forfeit any remaining Appointments for that cycle. To avoid any charges, rescheduling must occur at least 24 hours prior to the scheduled Appointment and made before each renewal date, otherwise you will forfeit that Appointment.
For Set-Time Plans: You must schedule all Appointments and attend all Sessions before the allotted length of the Plan, otherwise you will forfeit any remaining Appointments in the Plan. To avoid any charges, rescheduling must occur at least 24 hours prior to the scheduled Appointment and be made within 30 days, otherwise you will forfeit that Appointment.
For Group Workshops: Please be on time, there will be a 5 minute grace period. If the doors are already closed, we will start the workshop without you. You will still be able to join, but come in quietly. You may not cancel or reschedule set group workshop times. If you are late and/or unable to attend, please ask your classmates what you’ve missed.
For Classes and Memberships: Please be on time, there will be a 5 minute grace period. If the doors are already closed, we will start class without you and you will not be able to enter to keep the integrity of the class’s peace. You may not cancel or reschedule set class times, just make sure to remove yourself as a participant at least 24 hours before the class starts if you cannot make it. If you do not remove yourself as a participant, the class you booked will go on your Membership record. If you are late and/or unable to attend, the class you booked will go on your Membership record as well. You can join the next one if your Membership allows.
Classes will be cancelled 24 hours before class time if less than 5 people sign up online. All Single Session Appointments - including Appointments made for any Plan - can be rescheduled or cancelled on your online profile. If you’d like to cancel a Plan, you must do so before your next renewal date, otherwise you will be billed for another cycle. Note that some Plans cannot be cancelled on your own due to the nature of the program. For example, there is a 6-month minimum contract for any Health Coaching Plan to ensure that we've tried all that there is needed to reach your goals. You must contact us directly if the cancellation option is not available on your profile. Both a contracted plan and a set-time plan will result in a $50 fee plus an additional $10 for every Session remaining in the contract or set-time plan. If you have a set-time plan, you may renew your Plan whenever you’d like. The Service Provider may reschedule or cancel any Appointments, Plans, Memberships, Classes, and Group Workshops. In which case, you are not responsible for any fees.
Payments and Refunds
Everything in Wellness Dreams is currently either a service or digital product, therefore there will be no returns or refunds for these. However, Wellness Dreams does partner with other companies who may distribute physical items. Here at Wellness Dreams, we value sustainability. Because of this, there will be no returns on any physical items because this action requires extra packaging materials, delivery emissions, and etc. If you are not happy with any physical product, please send an email with the problem and supporting pictures. All sales are final and there shall be no refunds, but you are subject to store credit up to the same price, limited to other items and single services. Each payment is made electronically upon booking Sessions through the website. If you hold a Membership and do not sign in for a class, you will be charged with the class walk-in price upon attending. By participating in services or purchasing products, you authorize Wellness Dreams LLC to charge your card. Fees/taxes may be collected. No services will be made until full payments are accounted for. All payments are non-refundable.
As a Certified Health Coach and as a Registered Yoga Teacher both with additional and continuing studies, the role of the Service Provider is not to prescribe or assess micro- and macronutrient levels; provide health care, medical or nutrition therapy services; or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, a Health Coach is a mentor and guide who has been trained in holistic health coaching to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes. A Yoga Teacher is a mentor and guide who has been trained in teaching yoga with the background of Ayurveda to help you improve your strength, balance, flexibility, stress levels, and etc. Ayurveda is a non-licensed profession; its practice was formally legalized under the passage of California Senate Bill 577 in January 2003. The Service Provider is not acting in the capacity of a doctor, licensed dietician-nutritionist, psychologist or other licensed or registered professional. Understand that the information received should not be seen as medical or nursing advice and is not meant to take the place of seeing other licensed health professionals. Any advice given by the Service Provider is not meant to take the place of advice by other professionals. If you are under the care of a healthcare professional or currently use prescription medications, you should discuss any dietary changes or potential dietary supplement use with your doctor, and should not discontinue any prescription medications without first consulting your doctor. You have chosen to work with the Service Provider voluntarily by booking services or purchasing Plans or Memberships.
Consent and Confidentiality
Personal Responsibility and Release of Health Care Related Claims
By working with the Service Provider, you agree to take full responsibility for your life and well-being, as well as the lives and well-being of your family and children (where applicable), and all decisions made during and after any Appointments. You expressly assume the risks of the purchasing services, including the risks of trying new foods or supplements, and the risks inherent in making lifestyle changes. You are aware that participation in yoga and other activities may result in accidents or injuries. You assume the risk connected with the participation in yoga and other activities and represent that you are in good health and suffer from no physical impairment which would limit his or her safe participation in yoga and other activities. You release Wellness Dreams LLC, its owner/director, employees, staff, and any and all other member from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which you ever had, now has, or will have in the future against the Wellness Dreams LLC, arising from the your past or future participation in, or otherwise with respect to, any services, unless arising from the gross negligence of the Service Provider.
Arbitration, Choice of Law, and Limited Remedies
In the event that there ever arises a dispute between you and the Service Provider with respect to the services provided pursuant to this Agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to you in the event that an award is granted in arbitration is a refund of the Appointment fee. Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to you. This Agreement shall be construed according to the laws of the State of Texas. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force.
You do hereby certify that you have received, read, understood, and agree to abide by the aforementioned terms and conditions. By being involved with Wellness Dreams LLC in any and all cases including but not limited to booking an Appointment or purchasing a Plan, Membership, or Course you agree to the aforementioned terms and conditions. You understand that you are giving up your right to sue, and you appreciate these and other risks that are inherent in each activity. You expressly agree and assert that participation in each activity is voluntary and you knowingly assume all such risks and elect to proceed with the participation despite them. You acknowledge that by clicking on “I agree to the terms and conditions” that you are freely and voluntarily and intend the complete and unconditional release of all liability to the greatest extent allowed by law.
